General Terms & Conditions

1. All work is undertaken strictly in terms of the trading terms and conditions associated with Cape Consolidate and customer acknowledges that he / she has contents of such conditions.

2. ALL ORIGINAL Pod’s MUST REACH 6A – 9 Karee road, Kraaifontein Industrial BY NOON ON THE 15th** OF EACH MONTH in order to be paid nett within 7(seven) days of the end of the following month, SHOULD THE 15th FALL OVER A WEEKEND THE CLOSING DATE IS THE FRIDAY BEFORE THAT WEEKEND. IF YOUR CLOSING DATE ARE EARLIER THAN OURS WE WOULD HAVE TO CLOSE FOR POD’S AS PER YOUR CUT OFF DATE.

3. Only original documents will be accepted. All documentation, loading and offloading documents must have the receiver’s name and signature. Just a transporter’s delivery note on its own does not guarantee payment will occur.

4. No liability is accepted for traffic fines, toll fees, over loadings, damages. And all excess payments on claims will be for the transporter’s account and deducted from whatever Cape Consolidate owes the above company.

AII overtime and / or standing time due to late arrival of the vehicles at loading / offloading points will be for the transporter’s account.

5. AII drivers must check quantities at loading and offloading points, reporting discrepancies to Cape Consolidate.

6. All drivers and or operators; must report any overloading / shortages to our office prior to leaving the loading or offloading points.

7. Ensure ADEQUATE. COMPREHENSIVE INSURANCE COVER (GOODS IN TRANSIT) as per cargo value quoted above. All risk policy MUST apply at all times. DAMAGES / LOSSES WILL BE FOR YOUR ACCOUNT AND DEDUCTED FROM WHATEVER CAPE CONSOLIDATE OWES THE ABOVE COMPANY.

8. All payment by insurance companies in the event of an insurance claim, must be made directly to the cargo owner.

9. All breakdowns, delays and accidents must be notified to Cape Consolidate immediately after occurrence.

10. UNDER NO CIRCUMSTANCES IS THE ABOVE – MENTIONED LOAD TO BE SUBCONTRACTED unless agreed to in writing.

11. You as transporter will be responsible to deliver the load in perfect condition. You will be held responsible for any damages shortages etc. Should you not agree with any of this load confirmation, please contact us as soon as possible.

12. PLEASE ENSURE THAT ALL LOADS ARE SECURED PROPERLY AND TARPED.

13. If the Transporter do not sign and fax / email this document to Cape Consolidate, we believe that the transporter agrees to the terms and conditions stated herein.

14. Should the transporter / sub-contractor directly approach our client, they will automatically forfeit all moneys due to them.

15. Should any P.O.D. not be received within 30 (thirty) calendar days of the delivery, then our liability to effect payment to you of the above-mentioned transporter tariff will be conditional upon us being paid by the relevant customer. Failing payment by us, you may of course claim from the customer direct. We contract with you on the basis that we have the right to set -off against any monies owing by us to you.
